Conditions of General Sale

Article 1: object

The purpose of these general conditions of sale is, on the one hand, to inform any buyer of the terms and conditions under which SWIMOUEST sells and delivers the products ordered and, on the other hand, to define the rights and obligations of the parties in connection with the sale of products by SWIMOUEST to its client. They apply, without restriction or reservation, to all sales of products offered by SWIMOUEST on its website 

 

Consequently, the fact that any person orders a product offered for sale on the SWIMOUEST website implies full and complete acceptance of these general conditions of sale, which the buyer acknowledges having read prior to his order. SWIMOUEST reserves the right to modify these general conditions of sale at any time.

Article 2: Prices

The sale prices of the products online on the SWIMOUEST website, indicated in euros, are those in force at the time of the order by the buyer. They do not include packaging and shipping costs, invoiced in addition to the price of the products purchased. The packaging and shipping costs will appear on the invoice, before the buyer’s validation of the order.

The selling prices of the products can be modified by SWIMOUEST at any time.

Article 3: Product characteristics

In accordance with Article L. 111-1 of the Consumer Code, the buyer may, prior to his order, take note, on the SWIMOUEST website, of the essential characteristics of the product (s) he wishes. order.

The buyer selects one or more products from the different categories offered on the SWIMOUEST website.

The offers presented by SWIMOUEST are valid while stocks last. For products not stored in its warehouses, the offers presented by SWIMOUEST are valid subject to availability from its suppliers.

The photographs, graphics and descriptions of the products offered for sale are only indicative and in no way binding on SWIMOUEST. In case a 

supplier modifies a product, the graphic representation of this one cannot engage the responsibility of SWIMOUEST, nor even affect the validity of the sale.

Article 4: Order

Any order implies acceptance without restriction or reservation of these general conditions of sale.

From the moment the customer has validated his order, he is considered to have accepted knowingly and without reserve the present general conditions of sale, the prices, volumes and quantities of the products offered for sale and ordered.

The buyer’s order must be confirmed by SWIMOUEST by email. The sale will only be considered final after the sending of this order confirmation to the buyer by SWIMOUEST and receipt by the latter of the full price.

SWIMOUEST recommends that the buyer keep the information contained in the order confirmation sent by it on a paper or computer document.

All orders placed on weekends will be processed on Monday. The 24-hour preparation period runs from Monday morning until Friday afternoon.

Article 5: Payment

Payment must be made when ordering online by the buyer. At no time can the sums paid be considered a deposit or down payment. All orders are payable in euros.

To pay for his order, the buyer has the following payment methods: credit card, telephone or bank transfer. The bank cards accepted on the SWIMOUEST website are as follows: Sum Up, Carte Bleue, Visa, MasterCard and PayPal.

The buyer guarantees SWIMOUEST that he has the necessary authorizations to use the payment method he has chosen, during the validation of his order.

SWIMOUEST reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum that would be due by the buyer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the SWIMOUEST website.

As part of the fight against fraud on the Internet, information relating to your order may be transmitted to any third party for verification.

Article 6: Delivery and receipt of goods

The products will be delivered to the address and name indicated by the buyer. Invoices are printable, but the final invoice can be attached to the package at the time of shipment. Failure to comply with the procedures set out below, no claim from the buyer will be accepted.

The customer must check the status of the order with the delivery person for any complaint to our After Sales Service.

Article 7: General Terms of Delivery

Delivery is made to the address indicated by the buyer when ordering. In the event that the buyer or recipient of the products ordered notices damage or a missing item, whether, in the condition or content of his package, he must report the incident to SWIMOUEST within a maximum period of 10 days. open upon receipt of the order by sending an email, otherwise the request may be refused.

According to the Hamon law of March 17, 2014, from June 14, 2014, SWIMOUEST reserves a maximum period of 30 days, upon validation of the order, to deliver the order. Beyond this period, if the customer wishes to cancel his order, he must send a registered letter to request a refund.

Article 8: Delivery by Colissimo

Delivery is made by the postman to the address indicated by the buyer. In the event of absence, the buyer or recipient of the products ordered receives a notice from his postman, which allows him to collect the products ordered, at the nearest post office, for a period of fifteen days, after this period, the package will be returned to the sender and the customer will have to pay shipping costs again to receive their order.

 

The buyer or recipient of the products ordered is required to check, in the presence of the post office attendant or the delivery person, the condition of the packaging of the goods and their content upon delivery. In the event that the buyer or the recipient of the products ordered finds damage or a missing item, whether in the condition or content of their package, the buyer or respectively the recipient of the products ordered is required: to apply the Colissimo procedure (in particular report the damage due, all complaints and reservations) and refuse the goods by immediately issuing a report of an anomaly to the post office attendant (finding 170). – report these incidents to SWIMOUEST by email within a maximum of 30 working days upon receipt of the order, otherwise the request may be refused.

Articles 9: Delivery by Chronopost

Delivery is made by a carrier to the address indicated by the buyer. In the event of absence, the buyer or recipient of the products ordered receives a transit advice note from the carrier, which allows him to collect the products ordered, at the nearest post office or at a Chronopost relay point, during a period of fifteen days, after this period, the package will be returned to the sender and the customer will have to pay shipping costs again to receive his order.

 

The buyer or recipient of the products ordered is required to check, in the presence of the La Poste employee or the delivery person, the condition of the packaging of the goods and their content on delivery. In the event that the buyer or the recipient of the products ordered finds damage or a missing item, whether in the condition or content of his package, the buyer or respectively the recipient of the products ordered is required to apply the Chronopost procedure (in particular report the damage due, all complaints and reservations) and refuse the goods by immediately issuing a report of an anomaly to the Chronopost employee (finding 170). – report these incidents to SWIMOUEST by email within a maximum of 30 working days upon receipt of the order, otherwise the request may be refused.

Article 10: Delivery by UPS

Delivery is made by a carrier to the address indicated by the buyer. In the event of absence, the buyer or recipient of the products ordered receives a delivery notice from the carrier, which allows him to collect the products ordered from a relay point or to reschedule a new delivery with UPS for a period of 10 days. , after this period, the package will be returned to the sender and the customer will have to pay shipping costs again to receive their order.

 

The buyer or recipient of the products ordered is required to check, in the presence of the UPS representative or the delivery person, the condition of the packaging of the goods and their contents on delivery. In the event that the buyer or the recipient of the products ordered finds damage or a missing item, whether in the condition or content of his package, the buyer or respectively the recipient of the products ordered is required to apply the UPS procedure (in particular report the damage due, all complaints and reservations) and refuse the goods by immediately issuing a report of an anomaly to the UPS representative – report these incidents to SWIMOUEST by email within a maximum period of 30 working days upon receipt of the order, otherwise the request may be refused.

Article 11: Delivery times

The delivery times are as follows: from 48 hours to 30 working days following the items ordered from their payment. SWIMOUEST undertakes to give you a date or a slice for the delivery time when ordering. These deadlines are provided for information only. Any excess

possible in terms of deadlines can give rise neither to damages nor to withholding or cancellation of the order by the buyer.

In any event, and in accordance with the provisions of Article L. 121-20 of the Consumer Code, the products ordered will be delivered within a maximum period of 30 days from the day following that on which the buyer has registered his order, subject to full payment of the price. In the absence of delivery at the end of this period, the buyer will have the possibility of cancelling his order. The sums paid by the buyer will then be returned to him without delay, to the exclusion of any other compensation. The buyer must make his request in writing (e-mail to the coordinates indicated in the contact section of the SWIMOUEST website). SWIMOUEST will then proceed to an investigation with the carrier concerned prior to the cancellation of the buyer’s order and the reimbursement of the products ordered and not delivered.

An investigation with the carrier can take up to 21 working days. If during this period, the package containing the products is found, it will be at the buyer’s choice either immediately re-routed to the place of delivery designated in the order form, or kept by SWIMOUEST which will reimburse the products ordered but not delivered. On the other hand, if the package containing the products ordered is not found at the end of this period of 21 days of investigation, SWIMOUEST will proceed at the choice of the purchaser, either to the reimbursement of the products ordered not delivered, or to a new shipment at SWIMOUEST’s expense of the products ordered by the buyer. In the event that the products ordered are then no longer available, the provisions referred to in Article 11 will be applied. In the event of an exchange of product (s), the delivery costs will be borne by the buyer.

Article 12: Return of products

The products can be returned by the buyer under the conditions and according to the instructions below. The products must be returned to SWIMOUEST in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the signed return slip. SWIMOUEST accepts the return of any item purchased on our website if it is returned within 14 days from the date of receipt of the order by the buyer.

Sale products will not be refunded, only a credit for the amount of the item will be made.

1 / Item returned during the 14 day withdrawal period:

THE PRODUCTS MUST BE RETURNED IN THEIR ORIGINAL PACKAGING, IN PERFECT RESALE CONDITION, ACCOMPANIED BY THE RETURN VOUCHER.

You have 14 days from the date of receipt of the items to notify us of your desire to return an item that does not suit you. An exchange or a credit note in the form of customer credits will be made.

This credit will be valid for 6 months from the date of creation.

If you cancel your purchase, within this cooling-off period of 14 working days, we will refund the amount of the price of the item to your customer account (provided that your entire order is cancelled).

The return costs are always your responsibility whatever the reason.

If you want an exchange within this 14 working day withdrawal period, we will cover the cost of returning the item only if the initial order was delivered by Colissimo.

Return shipping costs are your responsibility.

If a product is unavailable in your order, the amount of the price of the item, as well as the delivery costs, will be credited to you.

For club member returns, only the amount of the item price will be credited, packaging and delivery costs will not be credited.

For clubs, if an exchange is requested and the amount of the exchange is less than € 100, shipping costs may be billed.

2 / Items returned after 14 days

 In the event that you return an article beyond 14 days after the date on which it was delivered to you, without this resulting from an error on our part, only the amount of the price of the article will be refunded in the form of customer credits. 

This credit will be valid for from the date of creation and valid for a total of 6 months.

Any package received beyond 30 days will be refused and payment of the amount of shipping costs will be requested to return your package.

For club members, payment of the amount of shipping costs will be requested for the reshipment of the order.

For clubs, if an exchange is requested and the amount of the exchange is less than € 100, shipping costs may be billed.

PLEASE NOTE, all personalization orders in the club boutique cannot be taken back or exchanged.

If the size does not fit, Swimouest cannot be held responsible, all sizes are given for information only and not an obligation to purchase.

Only the club chooses the markings, members cannot modify the markings of the club shop.

THE PRODUCTS MUST BE RETURNED IN THEIR ORIGINAL PACKAGING, IN PERFECT RESALE CONDITION, ACCOMPANIED BY THE RETURN VOUCHER.

SWIMOUEST does not accept packages sent postage due. Any risk associated with the return of the product is the responsibility of the buyer. Failure to comply with the procedure set out above and the deadlines indicated the buyer may not make any complaint for missing product or non-conformity or apparent defect of the delivered products, the products then being deemed to conform and free from any apparent defect.

3 / Returning a Defective product.

If I receive a defective product, I make my return request as indicated above, and I report the problem to Swimouest within 30 days maximum and I must imperatively return by email a photo of the product.

If the supplier accepts the return for defective, a return slip will be created and must be attached to the package.

 

Upon receipt of the article, Swimouest sends me back the same product otherwise a credit note will be credited to my customer credits.

This credit will be valid for 6 months from the date of creation.

If I return my item without agreement and it is refused, payment of the amount of shipping costs will be requested in order to reship my product.

Please note, for a defective return, the return costs are always the responsibility of the customer.

Article 13: Right of withdrawal

In accordance with article L. 121-20 of the Consumer Code, the buyer has a period of 14 clear days from the date of receipt, to return at his expense, the products ordered, for exchange or refund. The products must imperatively be returned to SWIMOUEST according to the procedure described in Article 14.

On the other hand, in accordance with article L.121-20-2 3 ° of the Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalized. Consequently, the right of withdrawal enjoyed by consumers under the terms of Article L. 121-20 of the Consumer Code cannot be exercised on any personalized product.

Article 14: Retention of title

SWIMOUEST retains full and entire ownership of the products sold until full receipt of the full price, in principal, costs and taxes included.

Article 15: Liability

SWIMOUEST cannot be held responsible for the non-performance of the contract in the event of a stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike, in particular postal services and means of transport. and/or communications. SWIMOUEST cannot be held responsible for any indirect damage that may arise from the purchase of the products. SWIMOUEST cannot be held responsible for any loss of data or files. It is the buyer’s responsibility to make all the necessary safeguards relating to his order (s).
